GENERAL:
 

1. Where you give a purchase order in electronic media through the website you use, this is assumed that you accept the preliminary information form and distance sale agreement offered to you.

2. The Customers are subject to Law No. 6502 on the Protection of the Consumer and the provisions of the Distance Agreements Regulation (RG:27.11.2014/29188) as well as other legislations for the sale and delivery of the products they purchase.

3. The cargo fees such as the shipment expenses of the product will be paid by the customers.

4. Each purchased product is delivered to a person and/or organization residing at the address stated by the customer on the condition of not exceeding the legal period of 30 days.

5. The purchased product must be delivered in full and with the qualities defined in the order and if any, together with the documents such as a certificate of warranty.

6. If the sale of the purchased products is not possible, then the seller must notify the buyer in writing of this matter within 3 days from the date when it is aware of the matter. The total cost must be reimbursed to the Customer within 14 days.


IF THE COST OF THE PURCHASED PRODUCT IS NOT REIMBURSED:

7. Where the customer does not pay the price of the purchased product or cancel on the bank records, then the delivery obligation of the Seller on the product is terminated.

 

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

8. After the delivery of the product, if it is determined that the credit card of the customer is used for payment by unauthorized persons and that the price of the sold product is not reimbursed to the Seller by the respective bank or finance institution, then the Customer must return the contractual product to the SELLER by meeting all shipment costs within 3 days.


IF A PRODUCT IS NOT DELIVERED ON TIME WITH THE UNFORESEEABLE REASONS:

9. If force majeure occurs which the Seller cannot foresee and the product cannot be delivered in due time, the Customer shall be notified. The Customer may request cancellation of the order, replacement of the product, or postponement of delivery until the obstacle is eliminated. Where the Customer cancels the order, the product price will be paid to him in cash within 14 days after the cancellation if the Customer has made the payment in cash. If the Customer has paid by credit card and cancels the order, the product price will be refunded to the bank within 14 days from the cancellation, but the bank is likely to transfer it to the buyer's account within 2-3 weeks.


OBLIGATION OF THE CUSTOMER TO CHECK THE PRODUCT

10. The customer shall inspect the contractual goods/service before receiving it; dents, broken, torn packaging, etc. damaged and defective goods/services will not be received from the cargo company. The delivered goods/services shall be deemed to be undamaged and intact. The CUSTOMER must carefully protect the goods/service after delivery. If the right of withdrawal is to be used, the goods/services should not be used. The invoice must be returned with the product.


RIGHT OF WITHDRAWAL:

11. CUSTOMER; Within 14 (fourteen) days from the date of delivery of the purchased product to him/her or the person/organization at the address he/she shows, he/she may use his/her right to withdraw from the contract by rejecting the goods without any legal and criminal liability and any justification, provided that he/she notifies the SELLER via the contact information below.

DURATION OF THE RIGHT OF WITHDRAWAL:

13. If the customer purchases a service, this 14-day period starts from the date the contract is signed. Before the expiry of the right of withdrawal, the right of withdrawal cannot be used for service contracts where the performance of the service is started with the approval of the consumer.

14. The expenses arising from exercising the right of withdrawal will be on SELLER’s side.

15. In order to exercise the right of withdrawal, a written notification must be made to the SELLER by registered mail, fax, or e-mail within 14 (fourteen) days and the product must not be used within the framework of the provisions of "Products that cannot be used for the Right of Withdrawal" regulated in this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL:

16. The invoice of the product delivered to the 3rd person or the CUSTOMER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution when returning. Order returns whose invoice is issued on behalf of institutions will not be completed if the RETURN INVOICE is not issued).

17. The return form, the box, packaging, and standard accessories, if any, of the products to be returned must be delivered complete and undamaged.

 

RETURN TERMS:

18. The SELLER is obliged to reimburse the total product price and return all documents putting the CUSTOMER under liability to the CUSTOMER within not more than 14-day-period from receiving the notification of the right of withdrawal and to accept the returned product within 20-day-period.

19. If the value of the product is decreased by a reason from the negligence of the CUSTOMER or the return becomes impossible, then the CUSTOMER must compensate the damages and losses of the SELLER in proportion to its negligence. However, the CUSTOMER will not be responsible for any changes and disorders arising from the reasons that the product or service is used in compliance with its purpose within the period defined for the right of withdrawal.

20. The discount amount used within the scope of the campaign is canceled due to exercising right of withdrawal when the price is decreased to an amount lower than the one defined with the campaign held by the SELLER.


PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CAN NOT BE USED

21. Underwear bottom parts, swimwear and bikini bottoms, make-up materials, disposable products, disposable products prepared in line with the request or explicit personal needs of the CUSTOMER and are not ok to return, goods that are in danger of spoiling quickly or are likely to expire, products that are not suitable for health and hygiene to be returned if the packaging is opened by the CUSTOMER after delivery to the CUSTOMER, products that mix with other products after delivery and cannot be separated by nature, except for those provided within the scope of the Subscription Agreement, it is not possible to return the goods related to periodicals such as newspapers and magazines, services performed instantly in electronic media or intangibles delivered to the consumer instantly, and audio or video recordings, books, digital content, software programs, data recording, and data storage devices, computer consumables if the packaging is opened by the CUSTOMER. In addition, before the expiration of the right of withdrawal period, it is not possible to use the right of withdrawal regarding the services started to be performed with the approval of the consumer in accordance with the Regulation.

22. Cosmetics and personal care products, underwear, swimwear, bikinis, books, reproducible software, and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridges, ribbons, etc.) must be unopened, untested, intact, and unused to be returned.


DEFAULT AND LEGAL CONSEQUENCES

23. The CUSTOMER accepts, declares, and undertakes that if he/she defaults in the event that he/she makes payment transactions by credit card, he/she will pay interest within the framework of the credit card agreement between the cardholder and the bank and will be liable to the bank. In this case, the relevant bank may apply for legal remedies; and may request the costs and attorney's fee from the CUSTOMER, and in any case, if the CUSTOMER defaults due to the BUYER's debt, the BUYER agrees to pay the loss and damage incurred by the SELLER due to the delayed performance of the debt.

24. You can make a Bank Transfer or EFT (Electronic Fund Transfer) to any of our Garanti Bank accounts (TL).

25. You may benefit from online single payment or online installment opportunities for all kinds of credit cards on our website. For online payments, the amount will be debited from your credit card at the end of your order.
